We may use third party services provider as we may consider appropriate including but not limited to payment gateway, transporters, website hosting and other services provider etc. We shall endeavour and coordinate with such services providers to resolve issues related to their services. However, in doing so, we may have limitations and may not be able to resolve the issue completely. In such event, you may directly coordinate with the relevant service provider for the resolution.

NO WARRANTY:

It is your responsibility to check the product details and related services or conditions (like delivery time etc) related to such products provided on the website, suitability for your use etc.

Delivery:

We will dispatch the products at the address you have provided. If the delivery attempted at such given address is failed due to your unavailability, you shall be liable for additional charges for subsequent delivery. 

Return, replacement or refund:

You may return any product purchased from the website but found defective or not matching with the description and we shall replace it at our cost. Provided that the defect in the product is not caused due to your act or omission and you return it immediately after delivery in an unused condition and in event within three (3) days of its delivery. Any such product not returned within three (3) days of its delivery shall be deemed as non-defective and as per the description unless proved otherwise.

In the event a product for replacement is not available, we shall refund cost of the said product paid by you.

You acknowledge that a product image, if any, on the website is indicative only and the actual product may vary in its colour, size etc. You are advised to check the product description before purchase of any product. The image sometimes does not show exact colour or may have slightly different features. Any such slight variation, which does not materially affect its usefulness, look and experience, shall not be treated as a product not matching with the description.

A product which is not defective or having any defect caused due to any reason not solely attributable to us or service provider engaged by us shall not be replaced or accepted by us as return and no refund will be payable for such product.

Save to the extent specifically stated in these terms and conditions, we shall not be in a position to entertain any request for replacement or return considering the nature of the transaction.

Sole remedy:

Your sole remedy for any defective product is to get a replacement product (or its cost if such replacement product is not available). You waive any other right you may have (including but not limited to right to get compensation) due to defective product to the extent permissible under the applicable law.

We shall not be liable for any indirect, consequential, special, punitive or remote losses or claims.

Force majeure (events beyond our reasonable control):

We or our representatives shall not be responsible for non-compliance or breach of any of the terms and conditions or its obligation resulting due to any circumstances beyond our reasonable control including natural calamities like flood, fire, war, pandemic, riots, civil unrest, non-availability of third party suppliers or services providers due to reasons beyond their control etc.

Waiver:

Save to the extent specifically provided in writing, any leniency or non-enforcement of any requirement as per these terms and conditions by us shall not be treated as a waiver.

Governing law and exclusive jurisdiction:

These terms and conditions and any transaction undertaken in relation to the Good Attic or website and any matter related or incidental thereto are governed by and construed in accordance with the laws of India.

You agree to submit to the exclusive jurisdiction of the courts at Nagpur (Maharashtra) for any dispute arising out of or related to The Good Attic, website or any transaction thereon.
